1. About FoundChat
FoundChat is operated by Othmane Nejdi ("FoundChat", "we", "us", or "our"). FoundChat helps businesses build AI agents and chatbots for customer service, sales, onboarding, lead capture, and other customer-facing conversations.
By creating an account, accessing FoundChat, or using the service, you agree to these Terms and Conditions. If you do not agree, you may not use FoundChat.
2. Eligibility and Accounts
To use FoundChat, you must be at least 16 years old and have authority to accept these terms on behalf of yourself or the organization you represent.
You are responsible for keeping your account credentials secure and for all activity under your account.
3. The Service
FoundChat lets you train AI agents using your websites, documents, knowledge bases, files, prompts, and other materials that you provide. You can deploy agents to answer questions, capture leads, route conversations, and assist customers.
We may improve, modify, add, or remove features over time. We may also suspend or limit parts of the service for maintenance, security, abuse prevention, or operational reasons.
4. Customer Content and AI Output
You retain ownership of the content you upload or connect to FoundChat. You grant us the rights needed to host, process, index, and use that content to provide and improve the service.
FoundChat uses AI models and automated systems. AI outputs may be inaccurate, incomplete, or unsuitable for a particular use case. You are responsible for reviewing, testing, and monitoring your agents and for deciding how to use AI-generated output.
5. Acceptable Use
You agree not to:
- Use FoundChat for unlawful, harmful, abusive, deceptive, or infringing activity.
- Upload content you do not have the right to use.
- Attempt to reverse engineer, scrape, overload, or bypass security or usage limits.
- Use FoundChat to generate regulated advice without appropriate human review.
- Misrepresent AI responses as guaranteed, professional, legal, medical, financial, or human-generated advice.
6. Subscriptions, Payments, and Paddle
Paid FoundChat plans may be offered as subscriptions or other paid products. Prices, plan limits, and included features are shown at checkout or on our pricing page.
Payments for FoundChat are processed securely by Paddle, our Merchant of Record. This means Paddle may handle checkout, payment processing, tax calculation and collection, invoices, subscription billing, cancellations, refunds, and payment-related support.
When you complete a purchase through Paddle, your payment relationship for that transaction is with Paddle and may also be governed by Paddle's Buyer Terms and other Paddle policies available at paddle.com/legal/buyer-terms.
7. Cancellations and Refunds
You can cancel a subscription according to the cancellation options provided by Paddle or inside your FoundChat account, where available. Cancellation usually takes effect at the end of the current billing period unless Paddle or applicable law requires otherwise.
Refund requests are handled under our Refund Policy. Our standard refund request window is 14 days from the original purchase date, subject to Paddle's terms, mandatory consumer rights, and applicable law.
8. Intellectual Property
FoundChat, including its software, interface, brand, design, features, documentation, and underlying technology, is owned by us or our licensors. You may not copy, resell, modify, or exploit FoundChat except as allowed by these terms.
9. Third-Party Services
FoundChat may integrate with third-party services such as AI model providers, analytics tools, communication tools, hosting providers, and payment processors. Your use of third-party services may be subject to their own terms and policies.
10. Privacy and Security
Our collection and use of personal information is described in our Privacy Policy. Our security practices are summarized in our Security Policy.
11. Disclaimers and Limitation of Liability
FoundChat is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, uninterrupted availability, and non-infringement.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, missed leads, business interruption, or decisions made based on AI output.
12. Termination
You may stop using FoundChat at any time. We may suspend or terminate access if you violate these terms, misuse the service, fail to pay, create security risk, or use the service unlawfully.
13. Changes to These Terms
We may update these terms from time to time. If changes are material, we may provide notice by email, in-product notice, or by updating this page. Continued use after an update means you accept the revised terms.
